Snapbot Photobooths Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your use of our website, products, and services provided by Snapbot Photobooths ("Snapbot," "we," "us," or "our"). By accessing our website or engaging our services, you agree to comply with these Terms.

2. Service Description

Snapbot provides photobooth and video booth services for events, including weddings, birthdays, corporate events, and more. Our services include, but are not limited to, the provision of photobooths, themed props, customizable backgrounds, interactive features, and instant prints.

3. Booking and Payment

3.1 Booking Confirmation:A booking is confirmed only upon receipt of a non-refundable deposit amounting to 50% of the total service cost. The remaining balance must be paid in full at least 3 days before the event date. In the case where the booking is made less than 3 days before the event, 100% payment is required at the time of booking.

3.2 Payment Methods:Payments can be made via bank transfer, UPI, Payment Gateway, credit/debit card, or any other method as agreed upon at the time of booking.

3.3 Pricing and GST:All prices quoted are inclusive of GST unless explicitly stated otherwise. The applicable GST rate will be added to the total service cost at the time of payment. Snapbot’s GSTIN will be provided on all invoices.

3.4 Late Payments:In case of late payment, Snapbot reserves the right to cancel the booking without refund. Any rebooking will be subject to availability and may incur additional charges.

4. Cancellation and Refund Policy

4.1 Client-Initiated Cancellations:
If you cancel the booking:
1. More than 15 days before the event: You will receive a refund of any amounts paid, excluding the non-refundable deposit.
2. Within 3 days of the event: No refund will be provided.

4.2 Snapbot-Initiated Cancellations:In the unlikely event that Snapbot cancels the booking due to unforeseen circumstances, we will offer a full refund of all amounts paid or an alternative date, subject to mutual agreement.

5. Photobooth Operations

5.1 Set-Up Requirements:
The client is responsible for ensuring that the venue meets the following requirements:
1. A power outlet of 220V within 5 meters of the setup area (generator power is not acceptable).
2. A designated indoor area only for the photobooth setup with an appropriate theme-based backdrop and lighting, as agreed upon prior to the event.
3. A side table for props and another table for the printer, with a theme-based cloth provided by the client.

5.2 Operation Time:The photobooth will operate for the duration agreed upon in the booking. Additional hours may be arranged in advance or on-site, subject to availability and additional charges of ₹10,000/-.

5.3 Operations and Maintenance:Snapbot agrees to have the photobooth operational for the time period specified; however, operations may need to be interrupted for maintenance, service, and/or photography optimizations. Snapbot will send a qualified technician onsite to maintain and operate the photobooth. Should we fail to provide a fully operational photobooth during the agreed-upon times, the client’s only remedy is a refund of the payment received. The client agrees that Snapbot will not be responsible for consequential damages. If only partial services can be provided due to conditions beyond our reasonable control, then the rental charges shall be on a prorated basis.

5.4 Setup and Takedown:Snapbot will deliver, set up, and remove the photobooth from the event location. Operation times may be adjusted if the event location or client ends the event prior to the contracted end time, and no refund of money will apply. The area where the photobooth is to be set up must be reasonably accessible and have level ground. Snapbot requires access to the venue at least 60 minutes before the event and 30 minutes after the event for setup and takedown.

6. Liability and Indemnification

6.1 Liability:Snapbot shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of our services. This includes, but is not limited to, damages for loss of profits, data, or other intangible losses.

6.2 Client Responsibility:
The client acknowledges that it shall be responsible for any damage or loss to the equipment caused by:
1. Any misuse of the equipment by the client or its guests.
2. Any theft or disaster (including but not limited to fire, flood, or earthquake).
3. Loss of power or power surges to the photobooths at any time, resulting in loss of pictures or damage to software and/or equipment.

6.3 Guest Control:Snapbot is not responsible for managing or controlling guest behavior at the event. The client is responsible for ensuring proper guest conduct and crowd control around the photobooth area.

6.4 Indemnification:You agree to indemnify and hold Snapbot, its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorney fees, made by any third party due to or arising out of your breach of these Terms, your violation of any law, or the rights of a third party.

7. Force Majeure

Snapbot shall not be responsible for any failure to perform its obligations under these Terms if such failure is caused by events beyond its reasonable control, including but not limited to natural disasters, strikes, rains, pandemics, or government restrictions.

8. Online Gallery and Digital Content

8.1 Delivery of Digital Content:Post-event, Snapbot will provide an online gallery or other digital content as per the package selected. The delivery timeline and method will be communicated to the client during the booking process.

8.2 Usage Rights and Approval:The client gives Snapbot approval to host event images online. The client hereby releases, discharges, and agrees to hold Snapbot harmless from any liability that may occur or be produced in the taking of said pictures, any subsequent processing thereof, as well as any publication thereof. This includes, without limitation, any claims for libel or invasion of privacy.

8.3 Content Ownership:All digital content provided remains the intellectual property of Snapbot until full payment is received. After payment, ownership of the digital content transfers to the client, subject to the usage rights granted to Snapbot for promotional purposes.

9. Confidentiality and Privacy

9.1 Privacy Policy:Your use of our website and services is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information.

9.2 Confidentiality:Both parties agree to keep confidential any information that is designated as confidential, unless required to be disclosed by law.

10. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Hyderabad, Telangana.

11. Amendments

Snapbot reserves the right to amend these Terms at any time without prior notice. Any changes will be posted on our website, and your continued use of our services constitutes your acceptance of the updated Terms.
